Forensic Accountant - A New Career?

Monday, December 31st, 2007

By Rebecca Game One of the newer areas, and also the fastest growing area, of accounting is forensic accounting. A forensic accountant has a unique job because the responsibilities involve the integration of accounting, auditing, and investigative skills. Using all of these skills, a forensic accountant is, in summary, a true investigator. Forensic accountants are trained to look beyond the numbers and deal with the business reality of the situation. A forensic accountant is typically an accountant that is hired by a large firm or company, but can also be engaged in public practice, or can be employed by insurance companies, banks, police forces, government agencies, or other organizations. The forensic accountant would be hired by such organizations to investigate, analyze, interpret, summarize, and present complex financial and business information so that it can be easily understood and properly supported. One that is employed as a forensic accountant can assist corporations in two main ways. 1. Investigative Accounting. By performing investigative accounting duties, a forensic accountant reviews the factual situation of the company and suggests possible courses of action. A forensic accountant can also assist with the protection and/or recovery of assets, and can coordinate with other experts such as private investigators, forensic document examiners, and consulting engineers in the event that a white-collar crime has occurred. The forensic accountant will also assist with the recovery of assets by way of civil action or criminal prosecution. 2. Litigation Support. Another main duty of a forensic account is to assist in obtaining documentation to form an initial assessment of the case and identify areas of loss. The forensic accountant may review the relevant documentation to assess the case and identify loss. This may require the financial accountant to assist with settlement discussions and negotiations, as well as attend a trial to hear the testimony of the opposing expert, and to provide assistance with cross-examination. Forensic accountants become involved in an array of investigations. This may involve: - Criminal Investigations, where a forensic accountant may be required to prepare a report with the objective of presenting evidence in a professional and concise manner; - Shareholders’ and Partnership Disputes, involving assignments that require a detailed analysis of numerous years of accounting records in order to resolve, for example, compensation and benefits disputes of shareholders or partners; - Personal Injury Claims, when a forensic accountant is asked to quantify economic losses resulting from an accident, often calculating resulting economic damage in cases of medical malpractice and wrongful dismissal; - Business Interruption, reviewing the details of an insurance policy, for example, to investigate coverage issues and the appropriate method of calculating the loss of areas such as business interruptions, property losses, and employee dishonesty (fidelity) claims; - Fraud Investigations, which involves a forensic accountant’s work in determining funds tracing, asset identification, and recovery, most commonly performed with employee fraud cases; - Matrimonial Disputes, which require a forensic accountant to trace, locate, and evaluate assets, including businesses, properties, and other personal assets; - Business Economic Losses, that of which includes areas such as contract disputes, construction claims, expropriations, product liability, trademark or patent infringements, and losses occurring from a breach of a non-competition agreement; - Professional Negligence, either through a technical perspective, where the forensic accountant will investigate a breach in an agreement, or through a loss quantification; and - Mediation and Arbitration, where a forensic accountant may be hired to become involved in an alternative dispute resolution so that individuals and businesses may resolve disputes with minimal disruption and with a minimal amount of time. While each forensic accountant will receive a unique assignment with each client, most assignments will include the following steps. 1. Meet with the client to understand the important facts, people, and issues at hand. 2. Perform a conflict check. 3. Perform an initial investigation. 4. Develop an action plan, setting objectives to be achieved, as well as the methods that should be used to accomplish them. 5. Obtain relevant evidence that may include documents, economic information, assets, or other proof of the occurrence of an event. 6. Perform the analysis, which may involve calculating economic damages, summarizing transactions, tracing assets, performing present value calculations, performing a regression or sensitivity analysis, utilizing a spread sheet, database, or other computerized model. 7. Preparing a final report. A forensic accountant may be hired by a variety of institutions, including attorneys and law firms; police forces; insurance companies; government agencies; banks, credit unions, and financial lenders; courts; and business owners. They may hire a forensic accountant based on their experience and qualifications, as well as their neutrality to their particular situation, especially if damages are involved. The typical forensic accountant will have a minimum of a bachelor’s degree, and often a master’s degree, in accounting or a related field. A forensic accountant is also usually a Certified Public Accountant (CPA). In addition to education, a forensic accountant should have personal characteristics that include curiosity, persistence, creativity, discretion, strong organizational and communication skills, confidence, and sound professional judgment. Forensic accounts that find the most career success are extremely detail-oriented as well. A forensic accountant may be employed by an accounting firm or by a large corporation to perform in-house investigations, or may be self employed as a consultant to such organizations. Proper Wedding Music - Foot Tapping The Whole Night Long

Sunday, December 30th, 2007

By Daisy May Is it time to boogie now that the wedding service has been finalized with the exchange of the vows? Damned right it is. So what are we waiting for - Music Maestro Please? Choosing the Proper Wedding Music can be a difficult task. Trying to please all will be hard because not everyone shares the same taste in music thus leaving you in an awkward situation. A sure way of achieving satisfaction is to hire a disc jockey. His or her collection of musical compilations will no doubt be unlimited so I am pretty sure all your needs will be serviced in the way of great music. The good thing about opting for recorded music is the fact that the guests can request their favourite songs. A good DJ with experience on weddings will entertain in between breaks. Explain in fine detail before hand what music you would like played on the turntable. How can you tell if the guests are enjoying themselves, well that is easy, watch their dance moves If the foot work is similar to that of Michael Flatly doing the river dance then you have chosen the proper wedding music. Another option for entertainment is to have a live band perform at the wedding. Depending on your place of venue you may need permission for this so be sure to check this out in advance. There are many types of music to choose for your wedding. It is crucial that you select the right melodies and tunes because without a doubt it is the music that sets the mood and creates the atmosphere. Contemplate during your wedding service to have a choir sing hymns accompanied by the church organist this can add an essence of ease among the guests and for the bride and groom. Before booking a live band for the wedding, ask if you can listen to their music first. Also have a chat about the emcee duties. Keep the music on going at all times with a little background music in between intervals. The reason for this is no one loves the dreaded silence when the music ceases to play.If you like jazz then play jazz. Rock and roll is a guarantee for a successful night. Remember rock around the clock - now that is proper wedding music for any reception. When have you never seen a foot tap to Bill Hayley and the comets A way of knowing that you did the evening justice is when the guests sing at the top of their voices to an extent where they overpower the music. This is an additional bonus because you now have karaoke putting and end to your special wedding evening. A site that comes highly reccomended by past present and future brides for wedding essentials is http://www.party-organizing.com. Need to relax after all that wedding planning. The Food Guide Pyramid

Sunday, December 30th, 2007

By Jonathon Hardcastle All types of foods contain nutritional substances that our body needs to grow , be fit, move, think, read, correct any cell damage and in other words, live! These nutritional materials, which actually compose our body, are proteins, fats, carbohydrates, vitamins, salts, and of course water. In order to receive all the things our organism needs, we have to maintain a balanced diet so as to ensure that we are receiving all the nutritional substances we need to survive. Food provides us with the necessary amount of “fuel” our body requires in order to perform all the necessary activities, like the beating of our heart, breathing, walking, exercising, etc. As the “fuels” are reduced, our body signals this lower levels of necessary substances and we feel hungry. By eating we again manage to balance the nutrients (fuels) we need in order to keep going and perform all the tasks we want with those we lost. This “fuel” quantity we need is measure with what it is known as calorie. One should keep in mind though that the amount of food each person needs to consume every day is different from individual to individual. It depends on a number of factors, like a person’s age, sex, his/her volume, the type and level of exercise performed, even the climate of the area the person lives in. Apart from these factors, aging, pregnancy, sickness or development can affect the amount of calories one needs to take so as to keep the level of energy on the necessary levels. The success of a sound diet plan is directly related to the quantities a person receives from each group of the nutritional substances. Specifically, a balanced diet is the one that is composed by 50-55 percent of carbohydrates, 25-30 percent of fats and 15-20 percent of proteins. One should not consider some foods healthier than others. What is the issue here is maintaining a balanced and healthy diet plan by consuming the right quantities, for the specific body structure and exercise level, out of all the different food varieties existing today. The general rules one has to follow, in order to keep his body and mind healthy, are simple. The amount of food consumed, which is measured by the calories one receives, should not exceed the amount required to maintain a balanced weight. The diet plan followed has to offer all the necessary food ingredients according to the quantities suggested by the Food Guide Pyramid. The total amount of fat consumed should not exceed the 30 percent limit. Reducing the amount of salt and alcohol beverages one consumes would be considered wise. The balance diet does not include more than three cups of coffee on a daily basis. Of course, 55 percent of the total amount of calories consumed has to come from carbohydrates, such as bread, rise, fruits, vegetables, pulse, pasta and potatoes. Eat well and stay healthy. Follow the Food Guide Pyramid and watch your body change! Jonathon Hardcastle writes articles on many topics including Food, Outdoors, and Games. How Much Do You Really Know About Cellulite?

Friday, December 28th, 2007

By Louise Forrest Most people, especially women, have heard of cellulite. You know it is bad, you think it is associated with being overweight and you have heard something about it resembling the appearance of orange peel. However, you are still unsure as to what exactly cellulite is. Well, whilst it is bad, you should know that if you have cellulite you are not on your own! Cellulite and the People who have it In this day and age cellulite is quite a common occurrence in woman worldwide. Generally speaking, cellulite is lumpy in appearance and it often attaches itself like superglue to your thighs and stomach. It is not particularly pleasant to look at and if you turn up on a beach with it, you are likely to be ridiculed. If you do have cellulite however, do not panic! Celebrities also get it and hardly any woman is immune, whether they are slim or not. It is basically caused by fat which is pushed up against the connective tissue beneath your skin. This is what causes the skin to look either lumpy or to dimple a little, often resembling the look of an orange peel skin. A good way to tell if you do have it or not, is to pinch the skin around your upper thigh. If the area is lumpy, it is often an indication that you are suffering from cellulite. Now not all cellulite is the same, it can range in severity from person to person and for some, it will not be as noticeable as it is for others. Certain things which affect how serious the problem will be include your genes, the amount of fat which is within the body, and the thickness of your skin. The Various Treatments Available and Which Ones Actually Work! Due to cellulite being a very common problem worldwide, there are unfortunately a lot of products out there claiming to solve all of your cellulite problems. There only to make a quick buck, some of the products available simply do not work. There is never a miracle cure for things and so you should always think twice if a product sounds too good to be true. However, there are some treatments out there which can reduce the appearance of the cellulite; it is just a matter of finding the right one for you! There are many misconceptions about Liposuction being a good cure for cellulite and the truth of the matter is, it does not do anything to change your cellulite, and if anything, it can make it worse. During Liposuction they suck out the fat which resides just under the skin, and the result is often a dimpled appearance, hence it can often cause more cellulite than you started with! Overall you can reduce the appearance of the cellulite but first you need to know what the cellulite needs. For example, the skin around cellulite is often dry and inflamed so moisturizing the skin and using anti inflammatory creams over time may help to minimize the appearance of cellulite. In order to really make a difference to the cellulite, treatment needs to be given to the dermis where most of the damage is usually done. Creams cannot usually help very much as they only treat the Epidermis which is the top layer of the skin. So, in order to treat cellulite most effectively, you need to: Strengthen the blood vessels Repair the cell membranes Reduce Inflammation Stimulate the production of collagen and elastin Moisturize the area Exfoliate Reduce any wasted water Prevent any free-radical damage In order to incorporate each of the above steps, treatment will involve a range of creams, technoceuticals and a good diet rich in vitamins and minerals which help to repair the skin. Overall, cellulite is extremely common and it can be treated, though it may not fully go away. Keep YOURSELF looking and feeling great with these great Skin Care Secrets from http://www.NaturalElements.co.uk In seconds you can access 36 beauty topics that will keep you looking younger and more radiant. You can access a full range of Certified Organic Beauty Products at Natural Elements Article Source: http://EzineArticles.com/?expert=Louise_Forrest http://EzineArticles.com/?How-Much-Do-You-Really-Know-About-Cellulite?&id=466805 order phentermine no prescription phentermine online without a prescription phentermine no prescription fast phentermine online mastercard

What The Wisest Man On Earth Said About Giving To The Poor And How You’ll Benefit From Doing It

Thursday, December 27th, 2007

By Matthew Robert Payne One day as I ate a hamburger in Mc Donalds a homeless man saw my Bible and asked me if he could show me a passage. He turned to this following passage and shared some of his wisdom with me. Today many poor people steal just to get by, many people addicted to drugs steal our goods to finance their habits. I dont condone addicted lifestyles but I dont despise them as I was addicted to prostitutes for twenty years. Proverbs 30:7-97 Two things I request of You (Deprive me not before I die): 8 Remove falsehood and lies far from me; Give me neither poverty nor riches Feed me with the food allotted to me; 9 Lest I be full and deny You, And say, Who is the LORD? Or lest I be poor and steal, And profane the name of my God. There is much wisdom in this proverb. Many people who have riches seem to deny the LORD in their life and yet its mostly to the poor that have the richest faith. There are many poor Christians in the world, there is a need for some 200 million Bibles in just China and Africa. Those poor cries might not reach your ears, but the Word of God understood and applied will make them rich if you send them a Bible.Okay, who is going to pay you back if you give to the poor? We have all heard if you give preachers your tithe or sow into a ministry that there is a return blessing from the LORD but will the LORD repay us for our mercy on the poor we meet. Proverbs 19:17 17 He who has pity on the poor lends to the LORD, And He will pay back what he has given. Did you read that? When you lend the poor money it is the Lord God Almighty that you are lending the money to. And the Lord God Almighty is no mans debtor. In the past six years I have given about five thousand dollars to the poor of my city and in one year my brother bought me $1500 worth of computer, $1000 sofa bed, and my parents payed for me to go on a short ministry trip to my favourite country India to preach and meet the wonderful Christians there which cost $3000. Over hundreds and hundreds of gifts to poor people were swiftly re-paid five years later with these three gifts from my loved ones. Jesus spoke of giving to the hungry, and the taking the homeless in the sheep and the goats parable and said that we were not giving it to the person who asked in our love, but we were giving it to Him. The king or leader of a country who establishes justice and equity for the poor and looks out for them will be established. Proverbs 29:14 (New King James Version)14 The king who judges the poor with truth, His throne will be established forever. That is a good promise! How is your government treating the poor in court in social justice? Do you think you are a generous sort of person? Proverbs 22:9 (New King James Version) 9 He who has a generous eye will be blessed, For he gives of his bread to the poor. If you exercise your generosity with the poors needs you will be blessed. You wont be short of money, you will be blessed. Some people dont like to feed an addicts sin. That is like giving me the money to spend on a prostitute when I was still stuck in my addiction. But drinkers and gamblers in many cases have starving families and a food parcel cant be gambled and drunk by that father.Proverbs 10:3 (New King James Version) 3 The LORD will not allow the righteous soul to famish, But He casts away the desire of the wicked. The LORD has been good to me even in my years of disobedience when I was not in any way righteous. But perhaps there is a righteous soul in your church that the LORD wants you to bless with $20 this week. Youll be surprised at how thankful a desperate person can be for just $20 and how strong a bond can be formed. I bought a poor person a Caf Latte and he wont ever let me forget it and every time he sees me he wants me to know one day hell take me out for coffee and cake. There is more joy in seeing a poor person blessed in a crisis than your new worship CD this week. Some people see the homeless and say he gets charity, he should get his life together and get on with it and pass by in judgment of the guy down on his luck like the Pharisee in the Good Samaritan parable. Beware Jesus brought this proverb to light in his parable. Proverbs 17:5 (New King James Version) 5 He who mocks the poor reproaches his Maker; He who is glad at calamity will not go unpunished. Be sure you dont judge the poor and reproach the living God! Who made you judge? The Good Samaritan parable should really make most people feel guilty. If you have poor where you can see, take them a present and give them some food. These promises will stand true. Many people say I cant tithe my ten percent and give more money to the poor. Surely the poor will always be with us. That is because the road is narrow that leads to life and men do not change without the resurrection power of the Holy Spirit. Sadly the poor are still with us when the richer Christians of the world could do a great deal more to change that. But if you are faithful God will look after you. He promises so. Proverbs 28:20 (New King James Version) 20 A faithful man will abound with blessings, But he who hastens to be rich will not go unpunished. Even my disability pension from the Australian government is eight times the salary of a full time driver in India. So I am rich in comparison to them. Seven dollars can bless 20 Chinese Christians with a Bible to share amongst themselves. Proverbs 13:7 (New King James Version) 7 There is one who makes himself rich, yet has nothing; And one who makes himself poor, yet has great riches. We hoarde our wealth and save and make investments and have all the best of the world and what have we got? Then we get a person in India who gives his life to Jesus, loses his family, his position and even his job and he becomes so rich in the wisdom of God. Some people without theologians teaching them read, If you will come after me, sell what you have, give to the poor and you will get reward in heaven, and come follow Me and guess what this Hindu does? He does it and is blessed with the secret counsel of the Lord and is anointed with a powerful ministry in return. Take the life of Sudhu Sundar Singh for a case in point. He was offered riches from his father and uncle that would mean he and his future wife would never have to work in their life and he denied that and was kicked out of his house shortly after as he would not deny his new found faith in Jesus Christ. Many Hindus find Jesus shortly before suicide; I have only known a few testimonies and all of them were suicidal before conversion and all devout Hindus who couldnt find truth in all their studies. Proverbs 13:13 (New King James Version) 13 He who despises the word will be destroyed, But he who fears the commandment will be rewarded. Jesus said:Luke 6:30 (New King James Version) 30 Give to everyone who asks of you. And from him who takes away your goods do not ask them back. So we have a command from Jesus here and people who despise this word of Jesus can be destroyed. But to the giver, he will be rewarded. So who are the brethren in the sheep and the goats parable? Well I dont know the answer, but we are commanded to love our neighbour as we love ourselves and Jesus said our neighbour is a stranger from a despised culture. Jesus asks us to give to everyone who asks of us and guess what? I do it! Its a simple command to build your faith. Fearing the Lord is obeying the Lord and the commands. Refusing a person who comes to you for spare change is not loving your neighbour. Proverbs 24:23 (New King James Version) 23 These things also belong to the wise: It is not good to show partiality in judgment. Many people if asked by a man in a suit who has said that he lost his wallet in a taxi and needs money for a fare home would hand him some change. But if asked by a person in jeans who has a stain on his shirt the same question we say in our heart that he is lying to us and feel justified when we dont give freely of our money. One time when I refused an elder drunken looking man, the Lord rebuked me with the sheep and the goats parable and the man who asked me for money disappeared into thin air. Not everyone gets an angel to teach them not to judge the askers by what they look like. James speaks on partiality when he says we treat the well groomed visitor with honour giving him the royal treatment and the best seats, but judge the drunk with harshness giving him the lowest seat. James warns us not to judge and seeing that Jesus did most of his preaching in the marketplace we should show mercy on the poor in the marketplaces also, for as James says, its not the poor that drag us into court battles. Proverbs 11:25 (New King James Version) 25 The generous soul will be made rich, And he who waters will also be watered himself. People who are generous will be blessed in the giving and will be blessed by the LORD. I think that modern teaching on giving fails miserably because in the modern prosperity doctrine being preached its as though we are going to get rich giving money away. If your giving is dependant on getting money back you have the wrong motive and your giving is making money your idol. When you see a poor person in need your compassion should move you to give. Jesus on one of His worst days was moved by compassion to heal, then preach, then feed 5000 people. And who gave him the food to feed all those people? A poor boy with barley loaves! Jesus fed the people from the gift of a poor boy, a bit of faith, and a Man moved by compassion. Look how much faith in God that little boy gave to poor givers all around the world. Look how many his mother who packed his lunch blessed, so too are you in the dark when you water those who water, but the LORD will bless you. How much faith can you spark in a faithful broke servant of the LORD when you send them a gift that puts food in their stomach that week or month? Remember $100 a month is a good wage in India. Proverbs 16:20 (New King James Version) 20 He who heeds the word wisely will find good, And whoever trusts in the LORD, happy is he. Giving to the LORD, giving to the poor is fundamentally not a money issue its a faith issue. Giving a tithe of your income and blessing servants in ministry with love offering and giving to the poor is basically putting trust in the LORD and his promises. Its our lack of faith and trust in God as a provider that stops us from giving and whilst some prosperity Gospels can go too far many other churches around the world are closing because of the lack of faith in their congregations. It seems the mega churches back their faith up in mega giving and they are growing. The fact of the matter is the Word of God does not return void and whilst some people are giving with distorted motives the Lord is faithful to His Word. Happy is a person that gives and He that heeds the Word will find good! Proverbs 29:7 (New King James Version) 7 The righteous considers the cause of the poor, But the wicked does not understand such knowledge. If you do not understand the needs of the poor you are not wicked. Focus on the righteous in this verse. If one Bible can bless a whole home church in China can you afford to buy one for a home church? You can bet they wont sell it, wont trade it on the stock exchange and youll be surprised that seeing as they have the five fold ministry over there that it may even go to a future Apostle, prophet or evangelist and you will be a co labourer in that Bibles harvest. Proverbs 28:27 (New King James Version) 27 He who gives to the poor will not lack, But he who hides his eyes will have many curses. Once again Jesus expanded this psalm to His Jewish audience. The person who hides his eyes is a person who does not help the broken hurting person that they can see on the street. They dont even read the cardboard sign they have begging for money. They walk past pretending that they dont see. One day I approached a person from behind playing a flute. I could see he had a cardboard sign and it wasnt facing me. The Holy Spirit said to me, Even a printed sign is asking you for money, he doesnt need to use his voice. I went up and got the change out of my pants to give to him. After I gave him three dollars, the Holy Spirit asked me, Ask him if hes like to go to lunch with you. We went to lunch and over a Turkish kebab we had a great conversation and much seed was planted in his life and he told me how the Lord always seems to bring kind people along to help him out when he ask Him to. The Holy Spirit then prompted me to give him $20 which brought this man to tears We fear giving the poor and tithing because of our fear of lack. But this promise says if we give to the poor WE WILL NOT LACK! Growing Legal Costs in the School System

Tuesday, December 25th, 2007

By Richard Hall The school system today is dramatically different from what it was 20 years ago. It used to be that children got off the bus, milled around the hallways, attended class, played on the playground, and went home safe and sound. Today, we see metal detectors at the entrances of schools, armed police officers in the halls, bomb-sniffing dogs, and the list goes on. Legal costs have grown significantly. Schools now pay for lawyers and find themselves on the defending end in court. While legal support has become a part of todays school system, it also means money that would go toward future education is affected. Funds that would typically be spent on books, transportation, and other educational funding are suffering. In some cases, the heavy load of legal expenses has closed school doors permanently. As risk of lawsuits build and problems within the schools are ignored or badly dealt with, more and more teachers are walking away. We already have a shortage of good teachers in this country; now, with legal costs rising and salaries down, this career field is even more unattractive. Legal support does have its place, but it has impacted the effectiveness of our schools. The solution is not straightforward. In recent years, we have seen some new laws passed that speak directly to frivolous lawsuits. For instance, President Bush is recommending a new clause be added to the education reform bill in which teachers and principals and school board members can take reasonable actions to maintain order and discipline in the classroom without the fear of being sued. While not everyone agrees with this amendment, it shows how serious the problem of discipline in the school system has become. School systems themselves can do a number of things on their end to reduce legal costs. For starters, the system can impose stiffer penalties for wrong behavior. Adopting a three-strike rule could help foster better behavior and increased safety. In addition, both teachers and students could be taught or trained to identify problem students and know when and how to take the appropriate action. The goal all the way around is to ensure the safety of the students without disrupting quality education. Richard A. Hall is founder and President/CEO of LexTech, Inc., a legal information consulting company. Mr. Hall has a unique breadth of experience which has enabled him to meld technology and sophisticated statistical analysis to produce a technology driven analytical model of the practice of law. As a busy civil trial attorney, he was responsible for the design and implementation of a LAN based litigation database and fully automated document production system for a mid-sized civil defense firm. He developed a task based billing model built on extensive statistical analysis of hundreds of litigated civil matters. Sign a Prenup - Don’t You Love Me!

Monday, December 24th, 2007

By Jeffrey Broobin Dont be insulted, if your future partner insists you sign a prenup, because it will protect you as well. You are anticipating the big day, its not about money, its about love and out of nowhere, you are asked to sign a prenuptial agreement. You dont want to make an issue of it; youre a person of reason and logic, and realize your future mates family is putting the squeeze on him. But the very idea of being asked to do this has left you confused and upset. You want to be considerate but you feel the pressure coming from your future in-laws. They are in a position where they want to protect their assets and you dont have much to protect. Your fiance and his family have more money. But when you met your fiance money wasnt a factor and not your reason to take the relationship to the next level. Money wouldnt keep you there. Be reasonable. Youre not marrying a control freak, so the prenup should not be a problem. You cant control everything, but the prenup can be crafted to be advantageous to you. Create A Solid Base for Your Relationship To begin with its a chance (If you decide to have a prenup) for you and your future mate to put your financial cards on the table, which is very prudent. Its good to know what will be expected in real terms, not just in your mind. Marriage is a joining of two people in a social and financial agreement. For the most part unless you or your future mate are wealthy, economic concerns are rarely brought up because of the fear of offending the other. This is a terrible error in judgement and can cause unreversible problems in the future. To create a great partnership you will need to sit down and draw up a plan that will be the foundation of understanding between you and your future spouse. The Prenuptial Agreement should be something you can both happily live with. It needs to be fair and be able to stand the test of time. If you both get what you need (Not Necessarily What You Want) you have a successful prenup. Both parties have a responsibility to contribute to the final prenup. The one with the greater financial assets does not rule. If they do, it will cause resentment and result in a weak foundation to what you hope is a lifelong relationship. The point is consideration, based on fairness and not greed. Each person has needs that must be addressed. Boost up Your Financial Position Even if you are not the one with the greatest assets the prenup can protect you as well and not leave you out in the cold. It actually can be a way to put you in a better financial position. So discuss and negotiate what your position should be. When someone loves you and wants to marry you, could you ever be in a stronger position for generosity. Its an opportunity to make a great deal. If you get a divorce and you dont have a prenup your once great love will not be in a generous mood and want to give you as little as possible. Your position should be to try to get more then the law would allow without a prenup. In a great majority of couples the wealthy partner will cover living expenses. The person with the least money or earnings usually gets to keep their assets in their own account to do with as they wish. From the very beginning of the marriage there could be an outright transfer of money or assets. Usually increasing as the years go by. This is a form of protection if the wealthy spouse dies first. Certainly your new mate will want to protect you in the event of their death. There are differences and variations in prenups as there are in people. Everyone has to customize their agreement to meet their specific needs. You must respect each other above all to work out the best possible prenuptial agreement. Will A Prenup Override Your State Law Wont the state laws alone protect you, in the event of death, divorce or terminal illness? Surely the state will be fair? Why do I need it now? Experts in this area claim you and your partner will never be at a point when generosity and fairness will have a stronger position, considering that you are in love. If for some unfortunate reason you wind up in divorce court things will be very different. If your partner dies the state cannot protect you. If your wealthy spouses family does not want to be generous or guarantee you security, there is no law that can protect you. They are not obligated to treat you as your spouse would if he/she was alive. Educate yourself specifically to laws governing marriage where you live and find out if there is any protection. When you get married without a prenuptial agreement you are voluntarily agreeing to the laws of the state you live in. So ignorance or fear of dealing with this issue can be very costly. Most states are equitable distribution states where the laws of the state will consider what each partner contributed financially to the marriage and if divorce occurs assets are divided according to your contribution. It may be approximately 50-50 split, but not necessarily. It would be a good idea to establish this from the beginning. If one of you are planning to stay home and take care of the kids make it clear that there will be a 50-50 split, if divorce happens. For the most part assets or inheritances brought into the marriage are not considered joint assets. But the day you get married the clock starts ticking. So if you marry a wealthy person who doesnt work, cant work for any reason, there may not be much of a contribution to your personal account, if any. In the final scene you could be shut out with nothing. Could there ever be a stronger reason for a prenup! Dont let the state decide for you. Their interests are different then yours. When you have a prenup you and your future mate have decided what you want and they are very different from what state law may or may not give you. If divorce comes you may not be happy, but you will be protected with a prenup. Most importantly Get Legal Advice You must each have your own lawyer to represent your personal interests. Any attorney will not do. Find a lawyer who specializes in this area. It will be more expensive, but worth every dime. Look for someone with a lot of experience and not someone right of law school. You wouldnt want to be a new surgeons first operation. Its a trust building process and you dont want it to be adversarial. Dont go into this with “what I can I get if things fall apart”. Its an opportunity for bonding. Remember youre getting married, and youre in love! And thats Wonderful! Just cover you assets! Finding Overseas Buyers - Is it Easier Now ?

Saturday, December 22nd, 2007

By Amit Kumar Chatterjee Perhaps the most daunting challenge any budding exporter faces is to find buyers for his/her products. Selling in international market has never been simple - with diverse language, geographical distance, cultural difference and lack of market knowledge posing real challenge to any manufacturer/ exporter. However, given right homework and planning, selling in overseas market today is easier, simpler and less expensive than it was a decade ago. There are many silver linings in the forms of positive Govt Policy, favourable international climate, less tariff and non-tariff barriers and above all easy and inexpensive access to an incredibly powerful and all-encompassing medium like Internet. Never before in the history of human civilization so many people from so vastly different places and societies freely interacted with each other as we witness today in Internet. So, how do today’s exporters take advantage of this favourable business climate and become successful ? The answer lies in thoughtful planning, effective implementation and perseverance. In fact, large number of exporters have used these advantages successfully as reflected in unprecedented export growth witnessed over last 10 years. How To Find Buyers To put it simply, there are only two ways you can find buyers of your products - either you find the buyer or buyer finds you. Your sales strategy must take into account both the factors and plan for effective use of both sources. Some of the ways to locate buyers are : Searching directories, trade literature etc. Using buyer-seller meets organized by trade associations Conducting Market Research Employing Commercial Agent/ Representatives Subscribing to information services etc. Some of the ways of attracting buyers are: Advertisement Promotion (e.g. direct mail) Trade Shows Web-sites Search Engine Marketing etc. How Important is the Internet in your Marketing Strategy ? 10 years ago - buying agents and trade shows were the two most popular avenues for selling in international markets. Participation in overseas trade shows was, and still is, prohibitively expensive for most small and medium exporters. Internet has not only made available new avenues for sellers, it has also drastically changed distribution pattern. Today, conventional distribution channel of seller to large importer to distributor to local stockiest to retailer is severely disrupted as small retailers from USA and Europe regularly visit foreign web-sites and order directly. This is a win-win situation as both buyer and seller stand to gain substantially by transacting directly without middlemen. It does add to business risks but profit margins also become very impressive by going direct. In coming years, we shall see more and more buyers coming through the Internet route. To be successful - you should be able to make best use of this opportunity that was not available to your predecessors even 10 years back. How to Study the Bible 5 Keys

Saturday, December 22nd, 2007

By Paul Griffitts This article was inspired by a book by E. W. Bullinger called How to Enjoy the Bible, it was written in the early 1900’s and has inspired me to devote a lifetime of research to the Word of God, I hope this will inspire you too. There are a few basic elements we must state before we get in-depth on how to study God’s wonderful Word. First we must know that there is only one requirement that is written in the Word pertaining to studying the Word. We must rightly divide it. II Tim. 2:15 Study to shew thyself approved unto God, a workman that needeth not to be ashamed, rightly dividing the word of truth. It matters little what people have thought or said the Bible says. There have been volumes that have listed the names and views of what people have said the Bible says and we would learn very little if we were to study it all we would only become confused. We need only to stay in the Word and leave not the pages of the Bible to understand the great truth that God has revealed. Secondly we must know the object of the Word of God and that is to reveal the Father and the Son. Third we must know what the subject of the Bible is; Jesus Christ the promised seed of Genesis 3:15 Gen. 3:15 And I will put enmity between thee and the woman, and between thy seed and her seed; it shall bruise thy head, and thou shalt bruise his heel. The Bible must therefore be seen and arranged with reference to Christ. The words, commandments and purposes of God are all centered in Christ. The thread from Gen 3:15 through Revelation is Christ and we must keep this first in our minds to truly know God’s Word. The literary form of the Bible: “THE WORD OF GOD” as a whole comes to us in two separate parts: one written, originally, in Hebrew; the other in Greek. Only in the Versions are these two combined, and bound together in one Book. This division, of course, is not human, though the names by which they are commonly known are. Up to the second century the term “Old Covenant” was used by the Greeks to describe the Hebrew Bible. This passed into the Latin Vulgate as “Vetus Testamentum,” from which our English term “Old Testament” was derived. The name New Testament is a one off of that. Fourth we must adhere to whom the scripture is written. This is the subject matter of the Bible. We have said that Jesus Christ is the subject of the Bible but the subject matter of the Bible is the people to whom the scripture is written. For example, there are the Jew, the Gentile and the Church of God. Fifth we must know what God is saying in reference to the subject, subject matter and the times that the scripture is referring to. These are sometimes called dispensations in the Bible. The Greek word for Dispensation is oikonomia and refers to the act of administering by the Figure Metonymy, the act of administering is transferred to the time during which that administering is carried on. The present dispensation called Grace; is not in Law, Judgment, or Glory. It belongs to the time which is called “the Administration of the Mystery” that Secret (as the word Mystery means in the Greek) “which in other ages was not made known to the sons of men” (Eph 3:5). It was “hid in God from the beginning of the world” (Eph 3:9). It “was kept secret since the world began” (Rom 16:25). But Paul was made the special administrator of all the truth connected with it. It was committed to him by God: and the Word of God could not be “fully preached” without it (Col 1:25, margin). The Word of truth can be preached today, but it cannot be “fully preached” without the truth connected with this Mystery. We have seen five principles which are required for Biblical study to “rightly divide” the Word of God. One, the requirement, we must rightly divide the Word. Two, we must know the object of the Word; to reveal God and His will to us who believe. Three, we must know what the subject of the Bible is; Jesus Christ. Four, we must adhere to the subject matter of the Bible; to whom it is written. Five, we must know what is written in reference to one through four which is time. When were the scriptures written and what times are the scriptures referring to? When we apply these five basic steps to studying the Bible, the eyes of our understanding will be enlightened that we may know what the riches of the glory of his inheritance in the saints is to us. How I Improved My Marriage Ten-Fold In One Evening

Friday, December 21st, 2007

By Beth Young It seems unlikely that anyone could improve his or her marriage in one evening. Well read on! Any positive step in the right direction is an improvement that will continue as long as the efforts continue to be made. As our recent MarriageAdvice.com poll showed, more than 40% of our 207 respondents identified that the single biggest frustration in their marriage was that their husbands “Didn’t Communicate Enough”. Below is a 8-step process to insure that both partners are communicating well. Step #1 - Decide To Communicate There are really only two options when it comes to communicating…either you do it or your don’t. It’s better to try and communicate and fumble around a bit than ignore the problem until it explodes like a pent up volcano. The wise spouse will work to resolve and discuss their feelings before the lava of scalding words overflows. Part of deciding to communicate will include setting aside a time each week to discuss family needs and concerns. This would also be a good time to resolve any minor conflicts that have arisen during the week but weren’t fully taken care of previously. Step #2 - Choose A Good Time If a more heated conflict occurs, it’s important to find the right time to discuss the matter. Waiting for your scheduled night for communicating would not be the best idea; however, taking a little time to give both partners time to cool off is important as well. Working to resolve a big conflict should wait until a time when both parties are not wrung out, angry, tire, or hungry. Your physical state directly impacts your mental state and your ability to work through problems in a rational manner. Additionally, as we allow ourselves time to calm down, we are better able to carefully think about what is really bothering us besides this specific event. In many cases, the topic of the current disagreement may not be the real problem. As we take time to ponder and look for the root of the problem, we are better able to expand our vision to the whole picture and not just have tunnel vision of the current problem at hand. Keep in mind, it may just be we’ve had a bad day and this problem was the last straw. It’s much easier to resolve a problem when we have a better perspective of what is really going on inside of our head and heart. Step #3 - Neutralize Defenses Before you have a deep discussion on something that is bothering you, consider two things. First, your spouse will be more receptive to the discussion if you reinforce your love, and express appreciation and confidence in their many attributes. Second, you choose if you will be irritated or angry, so you need to express yourself in a away that acknowledges your responsibility for your feelings. “You make me so mad!” Really is a false statement because you have allowed yourself to become mad. However,if you said, “When you make fun of me in front of our friends, it embarrasses me and I feel angry and frustrated,” you would be giving a very accurate statement about what has happened to you. Invite your spouse to help you solve this problem you are having, then they become part of the solution, not the problem. Step #4 - Use Humor Like they say, “laughter is the best medicine”. It’s true, physiologically, it relieves stress, and mentally it gives you a time out to relax. You will find that the longer you have been married, the more you have to laugh about. Many things that were painful or frustrating at the time can be viewed with great humor years later. Creating code words from some of these humorous events will help relieve tensions when a similar event threatens to evolve. When either my husband or I say something that is insensitive to the work effort done by the other, all we have to say is “I hate kidney beans”, and the other one immediately realizes their actions are bordering on being insensitive. It’s an easy way to control tense situations, prevent them from escalating and elicit a sincere, “I’m Sorry.” A word of caution, be sensitive to the situation. There are times when humor is neither appropriate or too late in coming and will be viewed as sarcasm. Sarcasm has no place in true efforts to communicate. Step #5 - Be Fair Be careful when discussing sensitive issues and don’t fall into touchy subjects that you know will enflame the argument. Looking for fair solutions may require compromising or acquiescing. Remember, you both need to give, sometimes a little, sometimes a lot, to resolve conflicts. Step #6 - Finding a Peaceful Stalemate There are times when you need to just agree to disagree. You don’t always have to agree 100% with your spouse, so there are occasions when a peaceful stalemate would be appropriate. It is only a legitimate solution as long as it isn’t just putting off the blow up for another time. A peaceful stalemate results in open discussion about your differences, why neither of you feel you can change at this time, and acceptance of each others differences. Step #7 - Willingness to Change When we truly feel loved, it gives us the freedom to risk changing and growing into a new and improved version of our old self. As we nurture our marriage relationship, the love and acceptance we feel will be liberating as we make minor and sometimes major changes in whom we are. Marriage is a wonderful opportunity to practice charity towards our spouse and provide a safe relationship where growth can occur. Step #8 - Bolster Each Other No matter what solution you have arrived at, it’s important to always express love and confidence in each other after a disagreement. As we show this love in days to come, it will be clear that no one is harboring ill feelings about the disagreement and that it was truly resolved. When both partners feel loved and supported in their relationship after a disagreement, it’s easier to resolve future problems with love and respect. By applying these communication steps, you have now discovered how you can change your marriage in one evening. It will take practice, but with time, you will discover that your marriage has improved more than ten-fold.
